These Terms and Conditions ("Terms") govern your access to and use of the JamboDrive application and services ("App"), provided by Mwanamama Enterprises Limited ("we," "us," or "our"). By downloading, installing, or using the JamboDrive App, you agree to be bound by these Terms. If you do not agree with these Terms, do not use the App.
1. Eligibility
- Age Requirement: You must be at least 18 years old to use the JamboDrive App.
- Legal Capacity: By using the App, you represent that you have the legal capacity to enter into a binding agreement with us.
2. Account Registration
- Account Creation: To use JamboDrive, you must create an account by providing accurate and complete information, including your name, phone number, and email address.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized use of your account. We are not responsible for any loss or damage resulting from your failure to secure your account.
- Account Termination: We reserve the right to suspend or terminate your account without notice for any violation of these Terms or any unlawful activity.
3. Services
JamboDrive provides ride-hailing services that connect passengers ("Users" or "Passengers") with independent drivers ("Drivers").
- Service Availability: While we strive to make the App available 24/7, we do not guarantee that the App will always be available or uninterrupted. We may suspend or discontinue the App at any time without prior notice.
- Driver Independence: Drivers are independent contractors, not employees or agents of JamboDrive. We do not control the quality, timing, or legality of the services provided by the Drivers.
4. User Conduct
You agree to the following:
- Lawful Use: Use the App only for lawful purposes, and do not use it to engage in illegal activities.
- Respectful Behavior: Treat other users, including Drivers, with respect and courtesy.
- Accurate Information: Provide accurate and up-to-date information when creating your account and booking rides.
- No Interference: Do not interfere with the operation of the App, including attempts to hack, disrupt, or misuse the platform.
5. Payments
- Fare Calculation: Fares are calculated based on factors such as distance, time, and current demand. You will be provided with an estimated fare before booking a ride, but the final amount may vary based on the actual trip.
- Payment Methods: You must provide a valid payment method, such as a credit card, debit card, or mobile money, to pay for your rides.
- Payment Authorization: By providing payment details, you authorize JamboDrive to charge your payment method for all rides and related fees.
- Refunds: All payments are non-refundable unless otherwise stated by law or in these Terms.
6. Cancellations and No-Shows
- Passenger Cancellations: You may cancel a ride request within a specified time frame without incurring any charges. After this time, a cancellation fee may apply.
- Driver Cancellations: Drivers may cancel a ride for valid reasons, such as incorrect pick-up details or unsafe conditions. You will be notified of any cancellations.
- No-Shows: If you fail to show up at the pick-up location within a reasonable time, the Driver may cancel the ride, and you may be charged a no-show fee.
7. Location Data and Privacy
- Location Use: JamboDrive collects and uses your real-time GPS location data while the App is active or running in the background to match you with nearby Drivers and provide accurate pick-up and drop-off services.
- Privacy Policy: Your personal information is collected, used, and protected in accordance with our Privacy Policy. By using the App, you agree to the terms of our Privacy Policy.
8. Intellectual Property
- License: We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for its intended purpose.
- Restrictions: You may not reproduce, distribute, modify, or create derivative works from the App without our prior written consent. You may not reverse-engineer, decompile, or disassemble any part of the App.
- Ownership: All intellectual property rights in the App and related content are owned by or licensed to Mwanamama Enterprises Limited.
9. Third-Party Services
- Third-Party Providers: The App may contain links to third-party services or be integrated with third-party platforms. We do not control and are not responsible for the content or services of these third parties.
- Third-Party Terms: Your use of third-party services is subject to their terms and conditions. We encourage you to review those terms carefully before using any third-party services.
10. Disclaimers and Limitation of Liability
- No Warranty: JamboDrive provides the App "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be free from errors or interruptions.
- Limitation of Liability: To the fullest extent permitted by law, JamboDrive is not liable for any indirect, incidental, special, or consequential damages arising from your use of the App. Our total liability to you for any claim related to the App or services shall not exceed the amount you paid for the services in question.
11. Indemnification
You agree to indemnify, defend, and hold harmless JamboDrive, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses, including legal fees, arising out of your use of the App or violation of these Terms.
12. Changes to the Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms in the App. Your continued use of the App after such changes constitutes acceptance of the revised Terms.
13. Governing Law and Dispute Resolution
- Governing Law: These Terms are governed by and construed in accordance with the laws of Kenya.
- Dispute Resolution: Any disputes arising from these Terms or the use of the App shall be resolved through good-faith negotiations. If a resolution cannot be reached, disputes will be settled through binding arbitration in Kenya.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
